Terms of Service

Overview

Welcome to Morgan & Reid.

This website is operated by Morgan & Reid Ltd, a company incorporated in the Republic of Cyprus.

Throughout these Terms of Service, references to "we", "us" and "our" mean Morgan & Reid Ltd. References to "you" and "your" mean the customer or website visitor.

By accessing our website or purchasing from us, you agree to these Terms of Service, subject to your applicable statutory rights.

Please read these terms alongside our Shipping Policy, Return and Refund Policy and Privacy Policy.

1. Our Products

We aim to ensure product descriptions, photographs, colours, dimensions and other information are accurate.

However, minor variations may occur due to manufacturing tolerances, lighting, screen settings or product characteristics.

We may update product information, availability and prices from time to time.

Nothing in this section affects your legal rights if goods are faulty, not as described or do not meet applicable consumer guarantees.

2. Ordering and Contract Formation

When you place an order, you are making an offer to purchase the selected products.

You will receive an order acknowledgement confirming that we have received your order.

A contract of sale is formed when we accept your order, normally by sending a dispatch confirmation or another express acceptance notification.

We may decline or cancel an order where there is a genuine issue, including product unavailability, suspected fraud, an obvious pricing error or inability to fulfil the order.

If we cannot fulfil an order after payment has been taken, we will provide an appropriate refund.

We will not rely on these terms to remove or restrict your statutory consumer rights.

3. Prices and Payments

Product prices are displayed in the currency applicable to the store or market through which you are purchasing.

For UK domestic orders, displayed prices include applicable UK VAT unless clearly stated otherwise.

Any applicable shipping costs or additional charges will be presented before you confirm your purchase.

Payment must be made using an accepted payment method offered at checkout.

Payments are processed through authorised payment service providers. We do not normally store complete payment card details.

4. Product Availability

All orders are subject to availability.

If an item becomes unavailable after you place an order, we will contact you and offer an appropriate solution, which may include a refund or an alternative product with your agreement.

We reserve the right to limit quantities where reasonably necessary.

5. Shipping and Delivery

We arrange delivery using third-party fulfilment and delivery providers.

Available delivery methods, charges and estimated delivery times are displayed at checkout and explained in our Shipping Policy.

Delivery estimates are provided in good faith and are not guaranteed unless expressly agreed.

We remain responsible for fulfilling our legal delivery obligations.

Risk of loss or damage generally passes to you when the goods come into the physical possession of you or a person you identify to receive them, subject to applicable law.

6. Address and Order Information

You are responsible for providing accurate contact, billing and delivery information.

If you discover an error, please contact us promptly.

We will make reasonable efforts to assist, although amendments may not be possible once an order has entered fulfilment or dispatch.

This does not affect your statutory rights.

7. Returns, Cancellations and Refunds

We offer returns in accordance with our Return and Refund Policy.

UK consumers may have statutory cancellation rights for online purchases, in addition to rights relating to faulty or misdescribed products.

Our voluntary returns arrangements do not replace or restrict those rights.

For full details, please refer to our Return and Refund Policy.

8. Consumer Rights and Product Quality

We are committed to supplying products that meet applicable consumer protection requirements.

Where UK consumer law applies, products must be of satisfactory quality, fit for their intended purpose and as described.

If goods fail to meet these requirements, you may be entitled to a refund, repair, replacement or another statutory remedy.

Nothing in these Terms of Service excludes or limits any right or remedy that cannot lawfully be excluded.

9. Promotions and Discounts

Promotional offers, discount codes and special pricing may be subject to specific conditions disclosed with the promotion.

Offers may be limited by availability, eligibility or promotional periods.

Unless stated otherwise, promotions cannot necessarily be combined.

We reserve the right to correct genuine errors and prevent fraudulent or abusive use of promotions, subject to applicable law.

10. Website Use

You agree not to misuse our website or interfere with its security, operation or availability.

You must not use our services for fraudulent, unlawful or unauthorised purposes.

We may take reasonable action to protect our website, customers and business from misuse.

11. Intellectual Property

Unless otherwise stated, the website's content, including product photographs, text, branding, logos, designs and other materials, belongs to Morgan & Reid Ltd or its respective rights holders.

These materials may not be reproduced, commercially exploited or distributed without the appropriate permission, except as permitted by law.

12. Third-Party Services

Our website uses third-party services for functions such as payments, delivery, customer support and returns.

These services may have their own terms and privacy policies.

We remain responsible for our obligations to customers under applicable consumer law.

13. Limitation of Liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot lawfully be excluded.

Nothing limits your statutory consumer rights.

To the extent permitted by law, we are not responsible for losses that are not reasonably foreseeable or that arise from circumstances for which we are not legally responsible.

We do not exclude liability for foreseeable losses caused by our breach of contract or failure to exercise reasonable care and skill.

14. Privacy

Personal information is collected and handled in accordance with our Privacy Policy and applicable data protection legislation.

15. Changes to These Terms

We may update these Terms of Service to reflect changes in our business, website or legal obligations.

Changes will not retrospectively remove rights that have already arisen under an existing purchase contract.

The current terms will be made available on our website.

16. Governing Law

These terms are subject to applicable law.

Nothing in these terms deprives consumers of mandatory protections provided by the laws of their country of habitual residence where those protections apply.

Customers may exercise applicable rights and remedies before courts or authorities having jurisdiction under relevant law.
